This disclaimer applies to all SmartsFitness digital fitness products, including training programmes, workout guides, ebooks, exercise challenges, instructional videos, educational downloads and general nutrition information.
Personalised coaching, subscriptions, in-person training and physical products may have additional terms. Those terms should be read alongside this disclaimer.
GENERAL INFORMATION
All SmartsFitness products are provided for general fitness, performance and educational purposes. They are not medical advice, physiotherapy, diagnosis, treatment, rehabilitation or a substitute for advice from a doctor, physiotherapist, registered dietitian or other appropriately qualified healthcare professional.
Do not ignore or delay professional medical advice because of information contained in a SmartsFitness product.
NOT PERSONALISED COACHING
A general digital product cannot consider your complete medical history, injury history, health, movement ability, experience, equipment, lifestyle or individual circumstances.
Unless you separately purchase personalised coaching, buying or using a SmartsFitness product does not create a personal trainer-client, coach-athlete, dietitian-client, physiotherapist-patient or doctor-patient relationship.
MEDICAL CLEARANCE
Consult an appropriate healthcare professional before beginning a new exercise or nutrition programme, particularly if you:
• Have an existing medical condition or injury• Take prescription medication• Have cardiovascular, respiratory, neurological, metabolic or musculoskeletal concerns• Are pregnant, have recently given birth or undergone surgery• Have been advised to restrict physical activity• Experience unexplained pain, fainting, dizziness or breathing difficulties• Are unsure whether the programme is suitable for you
If a healthcare professional advises you not to perform an activity, do not perform it.
Stop exercising and seek appropriate medical assistance if you experience chest pain, fainting, severe or unusual shortness of breath, sudden weakness, loss of coordination, sharp pain or other worrying symptoms. Call 999 or your local emergency service when urgent assistance is required.
EXERCISE RISKS
Strength training, cardiovascular exercise, jumping, sprinting and other physical activities involve inherent risks. These can include muscular soreness, strains, sprains, falls, equipment accidents, aggravation of an existing condition, serious injury and, in rare circumstances, death. No programme can remove every risk associated with physical activity.
YOUR RESPONSIBILITIES
You are responsible for deciding whether an exercise is suitable for your health and ability; selecting appropriate exercises, loads and training volumes; using correct technique and suitable equipment; checking that your equipment and training area are safe; following the instructions and warnings provided; and reducing, substituting or stopping exercises when necessary.
Start conservatively and progress gradually. Do not copy another person's loads or training volume without considering your own ability. Do not force painful movements or continue through sharp pain, instability, swelling or altered movement. Seek qualified help if you are unsure about an exercise or progression.
PAIN AND INJURIES
Normal muscular effort and temporary post-exercise soreness can occur. Persistent, worsening, sharp or unusual pain should not be ignored.
SmartsFitness products are not injury-rehabilitation programmes unless clearly described as such. Injuries and ongoing pain should be assessed by an appropriately qualified healthcare professional.
EQUIPMENT AND TRAINING ENVIRONMENT
Inspect your equipment and training area before exercising. Do not use damaged, unstable or unsuitable equipment. Follow the manufacturer's instructions and the rules of your training facility. Use safety equipment, spotters or qualified supervision when appropriate.
SmartsFitness is not responsible for the condition, installation or maintenance of equipment supplied by another business, gym or individual.
CHILDREN AND YOUNG PEOPLE
SmartsFitness digital products are primarily intended for adults unless clearly stated otherwise. Anyone under 18 should have permission from a parent or legal guardian and appropriate adult or professional supervision. Training must suit the young person's age, maturity, experience and physical development.
NUTRITION INFORMATION
Nutrition, calorie, supplement and food information provided by SmartsFitness is general and educational. It is not a personalised meal plan, medical nutrition therapy or treatment for a medical condition, allergy, intolerance or eating disorder.
Speak to a doctor or registered dietitian if you need personalised advice. Check ingredient labels and allergy information yourself. Use supplements according to the manufacturer's instructions and advice from an appropriate professional.
RESULTS
Individual results vary. SmartsFitness does not guarantee any specific increase in muscle size, strength, fitness or athletic performance, or any particular weight-loss or body-composition outcome.
Results depend on factors including consistency, effort, technique, nutrition, sleep, recovery, genetics, health, training history and adherence. Examples, testimonials and progress photographs show individual experiences and do not guarantee the same outcome for another person.
ACCURACY AND CONSUMER RIGHTS
SmartsFitness takes reasonable care when preparing its products and aims to provide clear and accurate information. Fitness and nutrition knowledge can change, and no general product will suit every person.
SmartsFitness is responsible for supplying digital content as described and for performing purchased services with reasonable care and skill. If a product is faulty, materially inaccurate or different from its description, contact SmartsFitness so the issue can be investigated and put right.
Nothing in this disclaimer removes or reduces your statutory consumer rights.
RESPONSIBILITY
SmartsFitness is not responsible for an injury or loss where SmartsFitness is not at fault. This includes problems caused by misusing or materially changing a programme, ignoring instructions or medical advice, using unsuitable loads or equipment, training beyond your ability, continuing through serious symptoms, or faulty third-party equipment.
Nothing in this disclaimer excludes or restricts responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
INTELLECTUAL PROPERTY
SmartsFitness products are supplied to the original purchaser for personal, non-commercial use only. They must not be copied, shared, resold, uploaded, reproduced, distributed, altered for resale or used to create another commercial product without written permission.
Purchasing a product does not transfer ownership of its copyright, branding or other intellectual property.
GOVERNING LAW
This disclaimer is governed by the laws of England and Wales. Any mandatory consumer protections available where you live remain unaffected.

SMARTSFITNESS RETURN AND REFUND POLICY

This policy applies to digital guides, training programmes and other downloadable products purchased from SmartsFitness.
DIGITAL PRODUCTS
Our products are supplied digitally and cannot physically be returned.
When purchasing a digital product, you may be asked to expressly consent to receiving immediate access to the product and to acknowledge that your statutory right to cancel will be lost once the download or digital access begins.
Once the digital product has been supplied following this consent and acknowledgement, refunds will not normally be provided because you have changed your mind, decided not to use the product or purchased it without checking that it was suitable for your needs.
FAULTY OR INCORRECT DIGITAL CONTENT
Nothing in this policy affects your statutory consumer rights.
Digital content supplied by SmartsFitness must be of satisfactory quality, fit for purpose and as described. If your product is faulty, corrupted, materially different from its description or cannot be accessed because of a problem on our side, please contact us.
We will first attempt to provide a working replacement, corrected file or another reasonable solution. If the issue cannot be resolved within a reasonable time or without significant inconvenience, you may be entitled to an appropriate price reduction or refund in accordance with UK consumer law.
DUPLICATE PURCHASES
If you accidentally purchase the same digital product more than once, contact us with the relevant order details. Once the duplicate purchase has been confirmed, we will normally refund the additional payment.
REQUESTING SUPPORT OR A REFUND
To report a problem or request a refund, contact SmartsFitness through SmartsFitness.com and include:
• Your full name• The email address used for the purchase• Your order number• The name of the product• A clear explanation of the problem• Screenshots or supporting information where relevant
Approved refunds will be returned to the original payment method. Processing times may vary depending on your payment provider.
CHARGEBACKS
Please contact SmartsFitness before initiating a payment dispute or chargeback. We will make a reasonable effort to investigate and resolve genuine access, payment or product issues.
STATUTORY RIGHTS
This policy does not exclude, restrict or replace any rights or remedies available to you under applicable consumer law.
